Terms & Conditions of Service and Refund Policy

Let’s be upfront about this.

A Terms & Conditions (T’s & C’s) and Refund policy exist because there is little trust left in “The Market”. There are more scammers and charlatans (Fraudsters) out there than ethical establishments. Not only do companies over promise and under deliver, sometimes clients or customers also do this and can take advantage and defraud companies. Because, we have an amazing record and an un-beatable refund policy, this policy protects both of us. You (Our Client) and us (The Provider).

This first section is written in plain English for humans and is not an accountant or lawyer-speak. If you want more formal, wordy robotic T’s & C’s then read to the bottom by all means.

Simply :

Our upfront commitment to you is:

  • If you feel that “The Harlequin Experience” (and all the additional bonuses) were not worth the money, then we will happily refund you.
  • Based on your choice of package. (Gold – 100%, Platinum – 200%)

All that is required from you is:

  • 100% Commitment and 100% Participation, we will do the rest.
  • It could not be simpler than that…

This refund policy gives you peace of mind that you are working with professionals and a legitimate organisation and now you can be sure that you are not going to waste your money. At first, there is a sense of risk, because we do not know each other. This policy is to avoid any confusion or later disappointment and to be clear about, what this is and how it works.

Our refund policy is designed to eliminate as much of that upfront risk as possible (Both for You and for Us).  This now gives us (The Provider) an opportunity to take a huge risk on you and to make a massive commitment to you.  If we do not deliver on our promise, then you need to be refunded.  We are sure that you can respect that this Refund Policy is not a “get rich” opportunity. As you can tell, there is a wonderful opportunity here where someone could take advantage of our good nature and capitalise on our money-back guarantee to make a quick buck. We are not in the “quick buck” business and of course, we know that you may not be either. However, to protect you (Our Client) and ourselves (The Provider) we need to include these T’s & C’s.  You cannot expect a 100% or a 200% refund if you do not Commit and Participate 100% through each phase of the programme**, not so?

To make sure that you can keep us in check and that we deliver and you get what you want, there are checks and balances all along the way:

  • Your Feedback (This is important for us to maintain a high standard)
  • Free Continuous learning Content (Depending on Bronze, Gold and Platinum packages)
  • Free Executive Coaching Sessions (Depending on Bronze, Gold and Platinum packages)
  • Peer-reviewed feedback
  • The more you feel that you are risking the more we will meet you there and risk 200% more.
  • Free Note Book and pen to take any additional notes you wish
  • ETC…

You can pull out at any time, no questions asked. (The Refund policy remains in effect). We expect to be held to a high standard (not to be confused with “the collective standard”) and we will do whatever we can to meet and maintain this standard for you.

General Conditions

By visiting our site and/or purchasing our services, you commit and engage in our “Service” and or Services and you agree to be bound by the following terms and conditions (“Terms of Service”, “Policy and Terms”), including those additional terms and conditions and policies referenced herein and in any additional or separate documentation. These Terms of Service apply to all students and participants, including without limitation to users who are browsers, vendors, customers, merchants, and / or contributors of content.  Any new features or tools which are added to the current course shall also be subject to Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service and or Content by posting updates and/or changes on our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to this Website and or Service Offering following the posting of any changes constitutes acceptance of those changes.

Important

You agree to: Not record, delete, distort, copy, plagiarise, reproduce, exploit, sell, duplicate, broadcast, or resell any portion or content of the Workshop, Course, Seminar, Training, Coaching or any other work, no matter what the format, digital, analogue, hard copy or soft copy. No derivative work may be gleaned or created from this work and any use of the Workshop, Course, Seminar, Coaching or Training and Content, digital or analogue of any kind whether through direct contact or any other contact such as our website/s or any other content, through which the service is provided, may be used, shared or distributed in any format whatsoever without consultation and / or explicit written consent from the Directors or Holding Concerns of Be Limitless PTY Ltd.

Prorate Refunds

There are no prorated refunds for workshops that are not attended.  This is not the commitment that you (Our Client) or us (The Provider) signed up for and is not a failing on the part of The Provider.  If you book a flight and miss that flight, which airline will refund you? 

Be Limitless PTY Ltd makes every effort to ensure that both BreakThrough and Chalice are scheduled well in advance (generally one entire calendar year in advance) to ensure that you have ample notice and opportunity to plan your life and book your workshop. If you fail to take the opportunity to attend and complete your “Harlequin Experience” within your agreed time period, Be Limitless PTY Ltd can not be held liable for non-attendance. If you are willing to double your risk and spend twice the investment, then take the Bronze package.  If you would like ZERO RISK, then take the Gold (100% money back). If you would like or REVERSE YOUR RISK, we suggest that you grab the Platinum (200% money back) Package. This protects both you (our Client) and us (The Provider).  Please realise, at this point that we (The Provider) take Five times the risk than you do (Our Client). 

If we need to affect a refund then this means that:

  1. We did not deliver and we risk losing you as a client
  2. We lose our investment of time into you
  3. We lose your investment in the programme
  4. We risk paying you a double payout
  5. We risk our stellar reputation

This will make us sad that we could not improve your life in any way.

Cancelations and Penalties

We have extended the Terms and Conditions of “The Harlequin Experience” from 120 days (4 months) to 180 days (6 months) to accommodate you as far as possible and to ensure that you have enough time to plan your life.  We, on the other hand, wait with bated breath for you to commit. Our logistics are extensive and affect every single participant and the outcome of each workshop. We make sure that there are more than enough confirmed workshops throughout the year and posted on the calendar (at least a year in advance) to accommodate you and ensure that you can complete your “Harlequin Experience”. This means that the rest is up to you. If you cancel or defer, this throws everything off track. To keep us both to our agreements we need to have clauses and penalties.  Please inform Be Limitless of any change of attendance prior to the course commencement date in writing (per e-mail).  Be Limitless reserves the right to reschedule publicised course dates should the minimum criteria for a workshop not be met. Participants will be notified of such mention by Be Limitless at least 4 days either via telephone and or email.

If you need to cancel your attendance please do so in writing, via e-mail ASAP.

  • 14 days or more in writing before course commencement – you may request a 50% refund.
  • 8 days or less in writing before course commencement – no refund.
  • Once the workshop commences, any non-participation without any communication, arrangement or agreement – your investment is forfeit.
  • Participants may find a replacement for their reserved place.

The terms and conditions that you agree to for BreakThrough and “The Harlequin Experience” also apply to Chalice, with additions stipulated on the Chalice registration form.  Please note: There are NO additional charges or hidden fees to attend Chalice (based on your package plan).  These are simple T’s & C’s specifically for Chalice.  We really do not like to applying these clauses or penalties and seldom impose them. They exist to protect you and your fellow participants. Please do not put us in a position where we need to enforce them.  Thank you.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you placed with us. We may, limit or cancel any quantities purchased per person, household or order with sole discretion. These restrictions are not limited to and may include orders placed by or under the same customer account, credit card and/or shipping address. We will attempt to notify you via the provided e-mail or phone number if we need to make a change, update or cancel an order.  At our sole discretion, we reserve the right to limit or prohibit orders that, appear to be fraudulent or placed by dealers, distributors or resellers.  You agree to provide current, accurate, up to date and complete account information for all purchases made through any of our online portals.  You agree to promptly update all personal, relevant information like your mobile number, account and other information, including your email address and credit card numbers and expiration dates so that you can complete your transactions without any hassle or for us to contact you if necessary.  If there are any changes to be made, please contact our support team at: limitless@belimitless.co.za for support, queries or to update your personal details. Refund Policy

Be Limitless PTY Ltd wants you to be satisfied with “The Harlequin Experience” or any other services that we provide and engage in. To raise the level of trust and to minimise and even reverse your risk we offer you a 100% and a 200% money-back guarantee and refund policy. Be Limitless PTY Ltd and HarlequinJHB makes every effort to deliver its service and on its promise of outstanding value. By its nature, this is a two-way Refund Policy and needs to be met by both parties. We would like you to put in your best effort to apply all the teachings, philosophies and mental strategies that we facilitate through each course, workshop, online content, videos, audio programmes, executive coaching, etc… and any other medium through which we communicate or distribute our content. To affect this policy, please ensure that all criteria are met on your end before triggering this policy or process.

T’s & C’s

No refunds can be provided if you do not commit and participate 100%  You may not request a refund of any kind if you:

  • Do not complete your Harlequin Experience within the designated time frame (180 days/6 months)
  • Do not participate in all the processes (We respect you – You will not be asked to do anything against your values)
  • (unless for obvious logistical reasons like not being in JHB or otherwise arranged in writing) Do not attend the Post-workshop event
  • Have opted for a payment plan and have not yet settled your account in full.
  • Do not participate in the FREE coaching sessions and Bonuses
  • Do not go through the audio and supporting processes and content
  • Do not indicate during the workshop that your needs are not being met
  • No refunds can be provided if any of the minimum requirements or your commitments were not reached.

No refunds can be provided without any timeous communication in writing (E-mail: limitless@belimitless.co.za) that you are not receiving value and you intend to request a refund. (We would at least appreciate an opportunity to make you happy, whether or not you continue or receive a refund.  If Be Limitless PTY Ltd has had to “carry you”, make acceptations, take a risk or make special arrangements of any kind on your behalf.  All payments are not up to date or made in a timely fashion.  If you opted for a payment plan, you are legally required to complete the remaining outstanding payments of your payment plan. If payments are not made on time, you agree to pay the interest that we incur on your behalf on all past-due sums at a rate of 2% per month. All commitments and arrangements (made in writing) must be reached before any arbitrary (perverse) or additional requests can be made.  No refunds can be provided without final notice, date of purchase, compliance or after midday following the post-course event after the completion of your “The Harlequin Experience”.  Failing any of these “Ts’s & C’s” it would be difficult in good conscience to either request or to affect a refund.  All refunds will be effected within 24 hours of you completing your “Harlequin Experience”, triggering the “Refund Process” and fulfilling compliance.

Refund Process

To date, after being in business for over three decades we have not being asked for a refund, this talks to our quality and to our commitment to provide you with value. This also makes this next part strange (yet necessary) to include.  If you have met all the “criteria” and you decide that “The Harlequin Experience” was not worth what you paid for, then, please trigger the “refund process”.  Please Note: Once you have triggered the refund process, unless otherwise discussed, arranged and agreed to in writing, all other T’s & C’s still apply and remain private and confidential. You may not distribute, share, slander or participate in any further work, content or any other offering offered by Be Limitless or any of its holding constituents. (Seems fair?)  To qualify for and trigger “The refund process”.  Please submit an “I would like a refund” E-mail to limitless@belimitless.co.za All communications must be submitted in writing for tracking purposes.  All Refund requests must be made within 24 hours of completing the final session of each workshop (BreakThrough or Chalice) and your “Harlequin Experience”. This will be time-stamped and trigger a refund form which will be sent back to you for your refund details and for your feedback so that we may see where we can improve our process and make you happy, anyway.  Thereafter, please submit:  Proof that you did the required work and that you have applied the necessary philosophies and mental strategies (part of participation).  Return all course, workshop, bonus materials and your workbook to the Be Limitless Head Office. Should you request a refund excluding your coursework, you cannot be granted a refund.  If we cannot assist in correcting the problem, we will issue you a prompt and FULL refund based on your selected package.  Be Limitless PTY Ltd will make every effort to meet their agreements and for you to meet yours.

Third-Party Links & Optional Tools

We may provide you with suggestions or access to third-party content, tools, and software. We obviously cannot and do not, either monitor nor have any input nor control over them. We use these tools or software, just like you and are subject to their (that provider) T’s and C’s. You acknowledge and agree that we provide these suggestions or access to such content and tools as they are made available. We cannot honour any of the third-party warranties or claims. Third parties do not represent us (Be limitless PTY LTD) and Be Limitless PTY Ltd does not represent them (third-party provider) and cannot make any warranties, representations or conditions of any kind and without any endorsement. We have no liability whatsoever from or relating to your use of these optional third-party tools or content. Any use of these “Third-Party” tools, content and or software is used entirely at your own risk and discretion, please be sensible and responsible. You must ensure that you approve and are familiar with the terms and conditions of the relevant third-party provider(s). If in the future, offer new services and/or features and content. Such new features, services, content and/or services shall also be subject to these Terms of Service.  Third-party sites or establishments may direct you to another third-party website, content or products, please be aware that these are not affiliated to or with us. We are not responsible for examining, evaluating or endorsing the accuracy of content or product and do not warrant or accept any liability or responsibility for any third-party materials, websites, products or services. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made about any third-party websites. Please review any third-party, their policies and practices very carefully and ensure that you understand them before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products must be directed to that third-party.

Indemnification

You agree to indemnify, defend and hold harmless Be Limitless PTY Ltd and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service and / or the documents which they incorporate by reference or your violation of any law or the rights of a third-party agreement.  You acknowledge that your participation in “The Harlequin Experience” and any other or further work offered by Be Limitless PTY Ltd is completely voluntary and of your own free will. You are responsible for yourself and whatever you do for the duration of the experience and thereafter. Be Limitless PTY Ltd and HarlequinJHB management, interns and employees do not accept any liability for loss or damages of whatever nature including consequential or special damages arising out of your or the participants’ attendance at Be Limitless PTY Ltd premises for whatever purpose, including the loss of personal possessions and effects. Be Limitless PTY Ltd does not advertise, endorse, cater for nor offer any form of drug rehabilitation, psychiatric or psychological treatment, assistance or guidance.  Please refrain from any misguided or misdirected complains or slander towards Be Limitless or “The Harlequin Experience” without at least consulting with us and allowing us to rectify the situation or any unhappiness. We would never do this to you and we would appreciate the same courtesy. No matter what, we would always like to maintain a good relationship with you and anyone who referred you and we are constantly seeking ways to improve our offering.  * The Harlequin Experience is the full and 100% participation of BreakThrough, Chalice, optional Performance Coaching, and Bonus materials, each followed by a Post Course Event.  ** Defined as: Completing and participating 100% in: Each Process, Door opened and stepped through, Interaction Executive Coaching, Additional Services, Post Course Events, Question and Answer, Peer interaction, Peer assessment, etc…

Payment Options

We accept the following payment methods:

EFT (Electronic Funds Transfer)

Upon Checkout, our banking details will be provided to you if you select EFT. Please use your order number (emailed to you) as the reference for your payment and email Proof of Payment to limitless@belimitless.co.za. Your order will only be finalised upon receipt of your Proof of Payment and once the payment reflects in the account.

Credit Card

We make use of PayFast Services to handle our credit card transactions. PayFast Services is one of the top, secure online payment services in South Africa and we can guarantee you of their security features. Please note that on the Payfast Services option they also have the facility of Instant EFT

Security Policy

PayFast Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site’s registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.

PayFast Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. PayFast Services Internet servers are protected by firewalls and intrusion detection systems.

The Merchant does not have access to credit details. PayFast Services continually reviews and enhances its security in line with technological changes.

CANCELLATION of orders due to non-payment and time-out:

All orders NOT paid for within 48 hours from purchase or which have timed out (60 min) will be automatically deleted from our system. Please make sure to forward proof of payment to limitless@belimitless.co.za within that period to prevent losing out on your purchase.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

How long we retain your data

Course dates permitting, you must complete Chalice within 180 days (6 Months) of completing your BREAKTHROUGH. Without prior arrangement Terms and conditions apply outside of this time frame.

Delivery of Services policy

Subject to availability and receipt of payment, requests will be processed within 24 hours and confirmed by way email. (for e.g. booking number / booking voucher etc. if applicable.)

RESCHEDULING

Please inform Be Limitless of any change of attendance prior to the course commencement date in writing or per e-mail. Be Limitless reserves the right to reschedule publicised course dates should the minimum criteria not be met. Participants will be notified of such mention by Be Limitless within 4 days either via telephone and or email.

CANCELLATIONS

14 days or more in writing before course commencement – 50% refund.

7 days or less in writing before course commencement – no refund.

Participant s may find a replacement for their reserved place.

 

CONDITIONS:

I acknowledge that my participation in The Harlequin Experience and any work offered by Be Limitless is voluntary and of my own free will. I am responsible for myself and whatever I do for the duration of the experience and thereafter. Be Limitless Workshops are experiential and anything I gain from these works is incidental. Be Limitless does not cater for nor offer any form of psychiatric or psychological treatment, assistance or guidance. Be Limitless cannot accept any liability for loss or damages of whatever nature including consequential or special damages arising out of attendance for whatever purpose. This includes the loss of any personal possessions and/or effects. I agree to have all my agreements fulfilled and any outstanding funds paid in full before the completion of The Harlequin Experience, unless arranged otherwise.

Customer Privacy policy

Be Limitless 42 (Pty) Ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Be Limitless 42 (Pty) Ltd bank account, the details of which will be provided on request.

Card acquiring and security

Card transactions will be acquired for Be Limitless 42 (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African.

Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer details separate from card details

Customer details will be stored by Be Limitless 42 (Pty) Ltd separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Responsibility

Be Limitless 42 (Pty) Ltd takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Country of domicile

This website is governed by the laws of South Africa and Be Limitless 42 (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Variation

Be Limitless 42 (Pty) Ltd may, in its sole discretion, change this agreement or any part thereof at any time without notice.
